ATCO Rubber Products, Inc. (“ATCO”) offers a full range of insulated flex duct products, which incorporate insulation of different R-values. Insulation R-values vary based on the type, thickness and density of the insulation material, and may determine how well the insulation controls heat flow and the potential for condensation and resultant water damage. The appropriate R-value may depend upon a number of factors, including installation location within the building and the local climate. ATCO makes no representation or warranty regarding the suitability of any R-value insulation for any specific job, and it is the sole responsibility of the contractor or installer of the flex duct to select and utilize flex duct with the appropriate R-value given the intended use, local and national building codes, and applicable conditions.

Accordingly, ATCO assumes no liability or responsibility of any kind whatsoever to any party arising from or related to the selection and/or installation of flex duct that incorporates insulation of an R-value that is insufficient or otherwise inappropriate for its intended use, or the conditions of installation. Any such liability or responsibility, including with respect to claims for property damage or bodily injury, shall be borne solely by the contractor or installer of the flex duct, who agrees to indemnify ATCO with respect to the same.
